China requires EU to eliminate fastener anti-dumping measures

The Fasteners Branch of the China Machinery General Components Industry Association (formerly the Fasteners Professional Association), which is based in Shanghai, issued an open letter to the EU Council on the 18th and strongly urged the European Union to immediately eliminate discriminatory anti-dumping measures against Chinese fasteners.

Feng Jinyu, chairman of the Fasteners Branch of China National General Machinery & Components Industry Association, said that China's fastener export enterprises welcomed and supported the recent ruling of the WTO Appellate Body, hoping to strengthen the dialogue and exchange between the EU and China fastener industry and promote The economic and trade relations between the two sides have returned to the track of health, mutual benefit, and win-win cooperation.

According to Feng Jinjun, in the past two years, due to the unfair treatment of EU enterprises in China, China’s fastener industry has suffered huge losses, which seriously affected the normal trade between China and the EU, and also caused irreparable damage to the EU market. .

China is the world's largest producer of carbon steel fasteners such as screws, nuts and bolts, and the EU is the main market for these products. In January 2009, the European Union decided to impose anti-dumping duties of 26.5% to 85% on China's carbon steel fastener products. According to the statistics of the Fasteners Branch of the China Machinery General Parts & Components Industry Association, China’s exports of fasteners to the EU from the same year dropped sharply from 1 million tons in 2008 to zero, and in 2010 exports only about 100,000 tons.

On July 31, 2009, China relied on the EU's relevant legislation and anti-dumping measures in the WTO dispute settlement mechanism. This case became China's first case of prosecuting the EU in the WTO.

The WTO Appellate Body, in its recently issued ruling report, found that Article 9(5) of the EU Anti-dumping Regulations concerning the separate tax rate stipulated by the WTO rules violated the WTO rules; at the same time, the Appellate Body overturned some of the rulings of the Expert Group in support of China’s position. China has ruled that the EU's anti-dumping measures against China's screws, nuts, bolts and other carbon steel fasteners are also in violation of the WTO rules in terms of domestic industry determination, fair comparison of normal values ​​and export prices.
