Chapter I General Provisions Article 1 In order to strengthen the navigation mark management, maintain the normal state of the navigation mark, and improve the quality of navigation mark maintenance, in accordance with the Regulations of the People’s Republic of China on Navigation (hereinafter referred to as the “Aviation Regulations”) and the Regulations of the People’s Republic of China on Waterway Management (below This Law is enacted for short, the "Channel Management Regulations" and other relevant national regulations.
Article 2 This method is applicable to the navigation mark management of inland waterways such as rivers, lakes, reservoirs and canals.
Article 3 The navigation mark management shall adopt the principles of unified leadership and hierarchical management. The waterway management agencies set up by the competent administrative department of transportation under the State Council and the competent transportation administrative departments of the local people's governments at or above the county level (hereinafter referred to as the navigation mark management agencies) shall be responsible for the navigation mark management.
Article 4 In addition to the direct jurisdiction of the Ministry of Communications, the navigation channels of provinces, autonomous regions, and municipalities directly under the Central Government shall be responsible for the establishment and management of navigation aids according to the division of the administrative area, and may also determine the scope of management through negotiation.
The navigation mark management of provincial rivers shall be handled by the navigation mark management agency set up by the competent traffic department of provinces, autonomous regions, and municipalities directly under the Central Government.

Chapter II Management Responsibility Article 5 The basic duties of the navigation authority management agency on navigation mark management are:
(1) Responsible for publicizing, implementing and implementing the instructions and regulations of the superior;
(2) To formulate rules and regulations for navigational aids, supervise and inspect their implementation;
(3) Responsible for the preparation and review of the maintenance plan of the navigation mark and the implementation of measures;
(4) To master the characteristics of waterways, changes in water conditions and distribution of obstructions, maintain the normal state of navigation marks, and issue notices of waterways;
(5) Inspecting navigation marks regularly to guide and assist the work of grass-roots teams;
(6) Prepare maintenance and repair plans for navigation mark boats and equipment, and organize the implementation;
(7) Collecting and arranging the technical data of navigation marks. Analyze the maintenance quality of navigation marks and summarize the experience of maintenance and management of navigation marks;
(8) to participate in the assessment of the construction of the navigation aid facilities and the layout of the calibration navigation maps related to the rivers, rivers, and rivers buildings and other water projects related to the navigation areas of this jurisdiction;
(9) Participate in the development, appraisal, promotion and use of new materials, new structures, and new processes for navigation marks;
(10) To punish violations of the provisions of the “Aviation Regulations” and “Regulations on the Management of Waterway Routes” and their implementing rules and the provisions for the protection of navigation marks and other relevant provisions in the Measures.
Article 6 The beacon management agencies at all levels shall, in accordance with the basic duties and responsibilities set forth in Article 5, formulate specific responsibilities of their own departments in light of the actual conditions of their own departments.
The basic duties of the grass-roots team in Article 7 are:
(1) Implementing the technical regulations and safety production system of navigation mark and completing the maintenance plan of the navigation area of ​​the area;
(b) Responsible for the setting, maintenance, and revealing of traffic signals;
(3) Mastering changes in waterways, timely adjusting bids and changing slots;
(4) To measure the channel scale according to regulations, report the situation of the channel to the superior, and promptly put forward proposals for the need for engineering measures in the navigation channel of the area;
(5) Responsible for the management and daily maintenance of navigation equipment and boats:
(6) Do a good job in the maintenance of the navigation mark and the work record of the signal station, and fill in the report form on time;
(7) to stop the behavior of damage to navigational aid facilities and report to higher authorities;
(8) The navigation aids for drift, loss and damage must be promptly restored. If it cannot be resumed in time, it shall issue a fairway power and notify the ship and relevant units.
Article 8 The navigation mark management agency shall be equipped with navigation mark workboats and equipment for maintaining navigation marks as required.
Article 9 The scope of jurisdiction, personnel establishment, and the arrangement of vessels and major equipment of the grass-roots team shall be implemented in accordance with the provisions of the ministerial "Technical Code for Maintenance of Inland Waterways."

Chapter III Distribution of Navigation Standards Article 10 The distribution of inland navigation aids shall be implemented in accordance with the provisions of the national standard, the Inland Navigation Aid Mark. The type of navigation mark distribution shall be determined by technical and economic argumentation according to the conditions of the navigation channel and shipping requirements.
Article 11 The navigation standard distribution should make full use of the natural water depth and meet the requirements of the fairway scale, so that the standard position is correct, the light quality is reliable, the color is clear, and the viewing distance is sufficient.
Article 12 The distribution of navigation marks on the confluence section of the river and the branch of the tributary and the estuary of the Tonghai section should pay attention to continuity and convergence, and clear the direction and boundary of the navigation channel.
Article 13 The allocation of navigation mark should pay attention to the effective combination between navigation marks, give full play to the role of the shore mark, and ensure that there is a prescribed maintenance depth in the boundary of the marked channel between the adjacent navigation marks on the same side.
Article 14 The preparation and examination and approval of navigation and distribution maps shall be carried out as follows:
(1) A route shall be prepared in accordance with the navigation routes allocated to Class I and Class II navigation routes, and the navigation route allocated to or allocated to the main route according to the three types of navigation routes may be stipulated by itself according to actual needs.
(2) Compilation of navigation standards and layout management agencies for aviation standards, compiling advices from drivers and Hong Kong supervision agencies, and formulating methods and contents according to the provisions of the Technical Specifications for Maintaining Inland Waterways. After preparation, it must be reported to the superior navigation authority for approval or filing. The navigation route is a basic construction route, and its layout and layout are submitted for approval according to the infrastructural procedures.
(3) The layout of the navigation mark should be revised regularly according to the change of the navigation channel.
(IV) Frozen river navigation standard maps shall be compiled annually and reported to the superior navigation authority for approval.
Article 15 When altering the layout of the navigation mark and adjusting the key navigation mark of the fixed mark, it shall be reported to the upper navigation authority for approval and executed, and shall notify the relevant unit.
Article 16 The setting of the navigation mark shall be based on the approved navigation mark layout diagram, so that the navigation mark set in the correct position, the structure is good, the installation is firm, and it is stable and reliable.
Article 17 Where the situation of obstructions within the waterway is unknown, or shallow watercourses and rocky riverbeds with frequent changes in the dry season, prior to the establishment of the standard, comprehensive or focused sweeps should be organized as appropriate.

Chapter IV Appointment Maintenance and Management of Navigation Marks Article 18: Shallow, dangerous navigation routes or important river sections shall be established on demand in accordance with the need to maintain a slot system, in order to strengthen the maintenance and management of navigation marks. The specific measures shall be formulated by the navigation authority of each level.
Article 19 When a sudden change occurs in a channel or a new obstruction occurs in a navigation channel, the grass-roots team shall immediately adopt the adjustment measures and report it to the superior and relevant departments. For the frequently changing shallow-water channel, the navigation mark should be adjusted according to the actual conditions of the channel.
Article 20 When a traffic signal station is set up to control the one-way navigation of a ship, it shall establish a method of command and control of the traffic signal station; when a control river section is provided with two or more signal stations, it must be clear that one of the two is a command station. The unified command of river navigation.
Article 21 The navigation mark management agency shall establish a report system for the change of navigation mark. After setting or adjusting the navigation mark, it shall carry out positioning or position check.
Article 22 The navigation mark management agency must establish a navigation mark inspection system and supervise its implementation. Daily inspections and periodic inspections of navigation mark inspections are carried out according to the provisions of the Technical Specifications for Maintenance of Inland Waterways.
Article 23 The navigation mark management agency shall periodically or irregularly publish the channel notice or channel energization, and timely notify the ship and relevant units of the condition of the navigation mark and relevant precautions.
Article 24 The navigation mark management agency shall be responsible for the preparation of the annual navigation mark maintenance plan. The execution of the plan must be inspected and reported. The adjustment plan shall be submitted to the examination and approval in case of special circumstances.
Article 25 The navigation mark management agency shall establish and perfect the navigation mark technology and statistical data files, and uniformly formulate the original records and statistical reports of the navigation mark work, and fill in the report on time, and regularly organize and archive the records.
Article 26 The navigation mark management agency shall establish the maintenance quality standards and inspection methods for navigation marks. Establish a navigation mark quality assurance system.
Article 27 The navigation mark management agency shall conduct the annual navigation mark quality assessment, and the main contents include the normal maintenance rate of the navigation mark, the installation of the standard mark, the technical status of the navigation mark and the use of the navigation mark.
Article 28 The navigation mark management agency shall establish a navigation mark equipment management system and perform maintenance and maintenance in accordance with the provisions of the Technical Specifications for Maintenance of Inland Waterways.
Article 29 The navigation equipment shall use stereotyped products and shall have a certain amount of reserves. The amount of reserves can be determined by the buoy management authority according to the amount of equipment used, consumption, and vulnerability.
Article 30 The navigation mark management agency shall establish and improve safety organizations and production safety rules and regulations, carry out safety inspections on a regular basis, grass-roots teams shall be equipped with safety equipment, and designated persons shall be responsible for safekeeping.
Article 31 When a grass-roots team finds or learns of marine occurrences on ships or boats, it shall go to the scene to understand the conditions of the navigation channels and navigation marks, and make records and report to higher authorities and relevant units in a timely manner.

Chapter V Distribution and Maintenance Management of Appointed Navigation Marks Article 32 The allocation of a navigation mark to a navigational river must be approved by the navigation mark management organization.
Article 33 The designated navigation aids referred to in these Procedures refer to;
(1) The navigational aids set by the construction and management units to ensure safety during the construction period of the rivers, rivers, and rivers, and after completion of the construction and navigation safety of the vessels;
(2) The navigational marks, navigation channels, anchorages, and navigation marks set in the production operation areas opened by enterprises and institutions for the production needs of the unit;
(3) The navigation mark set by the owner or operator of the ship in accordance with the regulations for the location of the sunken ship or sinking object and other reasons. Article 34 The management of designated navigation aids shall be implemented in accordance with these Measures and the Technical Specifications for Maintenance of Inland Waterways, and shall be guided and supervised by the navigation mark management agencies.
Article 35 When entrusting a navigation mark management agency to designate and administer a special navigation mark, the consigner must provide technical data related to the establishment of the mark, sign the agreement on behalf of the consignor, and administer the custody, and bear the cost of the navigation mark facility and maintenance management. The maintenance fees for the navigational marks on the bridge area shall be borne by the bridge management unit and the navigation mark management department at half of the total maintenance cost.
Article 36 In the construction of bridges and sluice gates, the construction unit shall establish navigation aids in accordance with the relevant provisions of the State, and related expenses shall be included in the general estimate of the project.
For the construction of bridges in special river sections, the additional navigation aids and other facilities that need to be demonstrated may be negotiated between the navigation mark management department and the bridge construction unit, and the bridge construction unit is responsible for the construction.
Article 37 After the construction period of the bridge and the completion of the bridge, the maintenance and management of the floating navigation standard in the bridge area, the bridge construction and the management unit shall entrust the navigation mark management agency to be responsible for it. Bridges and bridges and bridge lights shall be maintained and managed by the bridge management unit, and the navigation mark management agency may also entrust maintenance and management. When the bridge management unit independently maintains and manages the navigational aids in the bridge area, the following provisions must be implemented:
(1) According to the national standards "Inland Navigation Aid", "Main Dimensions of Inland Navigation Aids", "Inner Waterway Maintenance Technical Specifications" and the relevant provisions of these Procedures, a navigation mark shall be prepared and submitted for approval by the navigation authority management agency; ) According to the needs of the establishment of maintenance and management of the bridge area navigation agencies, in accordance with the requirements of the navigation system management agency to maintain and manage the navigation mark. Ensure the link between the navigation mark of the bridge area and the main fairway mark to ensure the unimpeded waterway;
(3) When changing the navigable bridge hole or adjusting the allocation of navigation standard in the bridge area, it must report to the navigation mark management organization for approval, and notify the relevant departments and bear the expenses of the navigation mark management organization to issue the waterway notice; when changing the navigable bridge hole, the bridge culvert and the bridge lamp on the bridge It should be adjusted synchronously with the maritime navigation mark.
Article 38 The ship lock signal sign is set and managed by the ship lock management unit. The buoys at the upstream and downstream approach channels of the lock, and the ship management unit should entrust the buoy management agency to set up and manage the buoys. If the ship lock management units set up and manage themselves, they must follow the principles stipulated in Article 37 of these Measures.
Article 39 The measures for the management of designated beacons other than bridges and locks associated with navigable facilities shall be formulated by the beacon management agency in accordance with the specific conditions of the navigation channels in the area under its own rules.

Chapter VI Protection of Aviation Marks Article 40 A navigation mark is an important navigation aid for safe navigation of a ship. It is protected by the laws of the country and no unit or individual may occupy or destroy it.
Article 41 When a navigation mark management agency sets up, moves or cancels a navigation mark, no unit or individual may obstruct, interfere with or claim fees.
Article 42 Within the scope of protection of navigation aid facilities, bamboo, wood, high-crop crops and aquatic organisms that affect their work efficiency, and fishing rods, fishing grates, fishing nets, etc. shall not be planted or buildings and other signs shall be planted. . Lights that affect normal performance of the navigation mark should be properly shielded.
Article 43 When carrying out facilities construction related to navigation and other construction operations, the need to move or demolish the navigation mark must be approved by the navigation mark management organization, and the cost of moving or relocating it shall be borne by the engineering construction or management unit. Article 44 prohibits the following acts that harm the navigation mark:
(1) Theft, destruction, looting, and invasion of buoys;
(b) illegally moving, climbing, smearing buoys;
(3) shooting and throwing items at the navigation mark;
(d) Climbing items on the navigation mark. They are livestock, ships, fishing equipment, explosives, etc.
(5) Other acts of damage to navigation marks.
Article 45 After a ship or a raft has collided with a navigation mark, its owner or operator must immediately report the nearest navigation mark management agency and port and shipping supervision agency.
Article 46 When a sunken ship or sinking object occurs in a navigation channel, the expenses incurred by the navigation mark management agency to ensure the safety of the ship’s navigation shall be borne by the responsible unit or the person responsible.
Article 47 The navigation mark management agency shall strengthen the maintenance and management of the navigation mark, actively carry out propaganda for the protection of the navigation mark, rely on the local government, and organize and carry out the mass hawking prevention work.

Chapter VII Penalties Article 48 The navigation mark management authority shall have the power to order correction of violations of laws and regulations and the provisions of the present Measures by units or individuals that violate the provisions of the "Aviation Regulations", "Fairways Management Regulations" and their detailed implementation rules and other laws, regulations and these Measures. Acts and penalties are given depending on the severity of the circumstances.
Article 49. In violation of the provisions of Articles 32 and 34 of these Measures, the navigation mark management authority has the power to order it to adjust, close or withdraw the navigation mark.
Article 50 In case of violation of Articles 40, 41 and 42, Articles 43 and 44 of these Measures, the navigation mark management authority shall have the power to order it to cease illegal activities, The deadline for restoration of the original state, the return of the original; causing losses, the navigation mark management department should order it to compensate for the loss.
The public security organs shall be punished in accordance with the Regulations of the People’s Republic of China on Public Security Administration Punishment for constituting violations of public security management regulations.
Article 51 Where damage to a navigation mark is caused in violation of the provisions of Article 45 of the present Measures, compensation shall be paid in light of the loss. The navigation mark management agency may impose a fine of up to 20,000 yuan depending on the circumstances, and the accident shall be subject to legal liability.

Chapter VIII Supplementary Provisions
Article 52 The navigation mark management of frontier rivers shall be implemented in accordance with the agreements signed between China and the relevant countries.
Article 53 The Ministry of Communications shall be responsible for the interpretation of these Measures.
Article 54 These Measures shall come into force on August 1, 1996. The “Interim Measures for the Administration of Inland Navigation Systems of the Ministry of Communications” promulgated by the Ministry of Communications in August 1962 is also repealed.
